Legal Clearances Required to start a hospital and Codes to be followed. Building and Specifically hospitals are governed by State and Central Laws. Most of the laws are state-specific, but there are few which are applicable all over India. Our team can help you do the documentation for getting legal clearances. Below are the legal aspects associated with building construction and the hospital.

1. Land

  • Registration: Pay registration charges once you acquire land. It is advisable to get the land registered in the name of a company, you intend to use for hospital setup. Registry cost varies state to state are in the range of 4-7 % of circle rates defined in the area.
  • Mutation: get your name recorded in Land records, this is important as doing registry will not automatically change the ownership of the piece of land in land records, have to apply for mutation.
  • Conversion: Land use is restricted, and is generally as Agriculture, Commercial, Residential. Some states have specific land usage for Hospitals. To build a hospital you have to get the “land-use” change to either commercial or hospital as per local laws. This process is called a conversion.

2. Building

  • Building plan sanction: Relevant authority as per land location, sanctions building plan. It can be a development authority, Municipality, Panchayat, etc in whose jurisdiction the particular landfalls. Same authority issues Building Completion/ Occupancy certificate once the building is completed. Some special development zone may require additional approval.
  • Fire NOC: Required Pre-construction and Final Fire License once the is construction completed. National Building code 2016 is in place and most of the state fire department follow NBC 2006 or 2016.
  • Pollution Control Board (PCB): Pre- and Post-construction NOC and Licence required. Wastewater treatment and Biomedical waste disposal systems to be placed as per the PCB requirement.
  • If the Land is on National Highway: Entry permission from NH authority.
  • AERB: NOC and License for putting Radiation equipment Like CT, X-ray, Linac. Wall and space requirements to be followed in the building.

3. Hospital

  • Clinical Establishment (CE) License: Health is a state subject and hence all the states have different CE acts and requirements to be followed.
  • PNDT License
  • Pharmacy License, Narcotic Drugs, and Other Drugs Related Licenses.
  • Lift, DG, and other Miscellaneous Licenses.
  • NABH and NABL Accreditation: Hospital is planned following the norms specified in NABH.
